Judicial Counter-Reforms in Romania and the role of national judges in order to preserve the Rule of Law

Abstract: In Romania, 2018-2019 legislative amendments, backed by the Constitutional Court, limited the freedom of expression of judges and prosecutors and established a separate prosecutor’s office for the investigation of offences by judges and prosecutors. These measures, supossedly taming the judiciary, sparked the reaction of few individual judges and of judicial associations, as the only serious attempt to preserve the rule of law.
